Moratorium notices

Moratorium notices are published under s26 of the Water Act 2000 to protect the natural ecosystem or to protect existing water entitlements and other authorities to take or interfere with water.

These moratorium notices:

  • Prevent particular applications (specified in the notice) from being accepted or dealt with while the notice has effect.
  • Prevent the starting of new works and changing existing works. Certain started works can be completed, provided this is done in accordance with the notice. It is an offence under the Act to construct works, in contravention of a moratorium notice.

Amended moratorium notices

Under s29 of the Water Act 2000 moratorium notices may be amended to provide for any matter which the original moratorium notice could have made provision.

Cape York Peninsula - amending moratorium notice (PDF, 193 kB)*

An amending moratorium notice has effect from 24 July 2008  and replaces the notice which took effect on 25 January 2007. The amended notice removes the Lockhart, Stewart and Archer Basin from the moratorium area (see notices of intent for the LockhartStewart and Archer  basins).

Continued effect of moratoriums under water resource plans

Many water resource plans may continue the effect of a moratorium notice either wholly or partly. These are not moratorium notices in themselves but do have very similar effects and as such have been included on this page under the heading 'continued effect of moratoriums under water resource plans'.
