Land Regulation 2008

The Land Regulation 2008 regulates the administration of State land, which includes allocating land to the most appropriate use and tenure. It also ensures that the community receives a fair and appropriate return on its land asset.

The regulatory impact statement, which reviews the rental provisions in the Land Regulation 2008, includes proposals for streamlining and improving the administration of rent charged by the State for leasehold land. These include:

  • rationalising rental categories
  • applying three-year averaging
  • introducing appropriate rental arrangements for charitable, sports and recreation, and telecommunication uses
  • increasing minimum rent levels to cover the cost of administration for private benefit lessees
  • divesting leasehold land from which the State derives little or no benefit
  • applying consistency to the level of fees for applications made under the Act
  • increasing the level of penalty interest charges for late payment of rents
  • increasing the rate of instalments for any post-Wolfe freeholding leases
  • increasing the minimum instalments for freeholding leases.

Anyone who currently rents State leasehold land will be affected by the proposed changes.
